  1. Scope of Application
    1. For all business relations between Toplife.zone as operator of the fitness program and the customer, the following General Terms and Conditions in the version valid at the time of the order shall apply exclusively. Deviating conditions of the customer will not be accepted unless the seller expressly agrees to their validity in writing.

 

  1. Offers and Service Descriptions
    1. The presentation of the fitness program on the website does not constitute a legally binding offer, but an invitation to place an order.

 

  1. Ordering Process and Contract Conclusion
    1. The customer can select the fitness program without obligation and place it in a so-called shopping cart by clicking on the button (start now, start fitness bet, start fitness bet now, etc.), and then complete the order.
    2. Payment can be made via credit card and PayPal. If the transaction could not be successfully completed and the payment has not been received by the seller within 10 calendar days after sending the order confirmation, even after a second reminder, the seller can withdraw from the contract and the order is no longer valid. The order is then considered as canceled with no further obligations on the part of the buyer and seller.

    1. The customer can choose from the available payment methods during and before completion of the order process.
    2. If third party providers are commissioned with the payment processing, e.g., PayPal, their General Terms and Conditions apply.

    1. The seller processes personal data of the customer for a specific purpose and in accordance with the statutory provisions.
    2. The personal data provided for the purpose of ordering goods (such as name, email address, postal address, payment data) are used by the seller for the optimal fulfillment and processing of the contract. This data is treated confidentially and is not passed on to third parties who are not involved in the ordering, provision, and payment process.

    1. Pregnant women and women who are breastfeeding should not use the fitness program. People with existing illnesses or those who are at risk of becoming ill should consult their doctor beforehand. The website operators are not able to assess the health condition of the customer, therefore the customer himself is obliged to consult a doctor or obtain medical advice prior to using or purchasing the offered fitness program. The customer expressly acknowledges this.

 

  1. Place of Jurisdiction, Applicable Law, Contract Language
    1. Place of jurisdiction and place of fulfillment is the registered office of the seller.
    2. Applicable law is the law of the Republic of Austria. This shall not apply if mandatory consumer protection regulations prevent this application.
    3. Contract language is German.

    1. Process and General Information
      1. The customer pays quarterly, semi-annually or annually for the fitness program. The prices are quoted on a monthly basis and can be found on the website. After payment has been received, the customer will receive an email with access data for the online fitness program.
      2. The customer has the possibility of receiving more money at the end of the selected period, depending on the variant, if he has not missed a single training day in the respective period. The payout amounts can be found on the website.
      3. If the customer waives the payout after the end of the period, the potential payout increases further at the end of the subsequent period.
      4. Training days must be confirmed online within 24 hours. Confirmation of the last set of exercises of a workout must be received no later than 11:59 p.m. of the current training day.
      5. The verification whether training has actually taken place is done by evaluating the training duration of individual sets of exercises. The training performance is compared with that of other training days, as well as with that of other users. If a day is not accurately accounted for, the responsible support team will review the training day manually. Only if there is a clear case of cheating, the day is marked as cheated.
      6. The Toplife.Zone fitness bet is automatically extended after the end of the period. Depending on the chosen option, the program is extended quarterly, semi-annually, or annually and the bet is debited again. An automatic renewal can be cancelled at any time via this link.
    2. Illness and Extraordinary Reasons
      1. If a customer falls ill during the training or is prevented from attending due to an extraordinary reason, the customer is entitled to reset his current training month. The user can do this in a timely manner directly online in the webapp. Timely means that the information must be given before the first day of training is missed.
      2. In special cases, such as a serious accident involving hospitalization, without access to the Internet or limited ability, it is also possible to have the training month reset after two days of missed training, so that the fitness bet is still valid. In this case, proof of this must be sent to the responsible support team, which will then review this individually.
    3. Technical Issues
      1. If errors are found by the customer in the webapp or on the website, the customer is responsible to contact the support team of Toplife.Zone via the support tool before missing the first day of training. It is no longer possible to determine whether there was really a technical defect several days later. If there actually was a problem, the training day will be credited.
      2. Toplife.Zone is not liable for server errors or hacker attacks.
      3. An error that leads to problems when confirming the training must be reproducible. That means it must be proven by the customer via screenshot or video and by contacting us in time (before missing the second training session) via the support tool.
    4. Account Activation and Deadlines
      1. After receiving the access data, the customer must activate the fitness program online by logging in and selecting a difficulty level. Once activated, the training will start the following day to ensure that the user has 24 hours to complete the first day of training.
      2. If the customer does not activate the account within 9 days, he is no longer entitled to any payout.
      3. The payout of the amount at the end of the respective training period is always automatic in case of entitlement.
    5. Money Back Guarantee
